Teilnahmeberechtigt sind alle Personen über 16 Jahren, die innerhalb des jeweils angegebenen Zeitraumes ein von Ihnen selbst erstelltes Video zum aktuellen Thema per MMS an 0660 10 20 500 senden, ausgenommen sind Mitarbeiter der Hutchison 3G Austria GmbH und der Lomographischen Gesellschaft. Die Gewinnermittlung erfolgt durch die Lomographische Gesellschaft. Die Gewinner werden telefonisch oder per SMS unter der Nummer, von der aus das Video versandt wurde, verständigt.

Der Teilnehmer erklärt sich mit der Einsendung bereit, von Hutchison 3G Austria GmbH und der Lomographischen Gesellschaft via MMS Informationen zum Gewinnspiel zu erhalten, sowie Hutchison 3G Austria und der Lomographischen Gesellschaft folgende Nutzungsrechte an den eingesandten Videos zu übertragen: Das zeitlich und örtlich unbeschränkte Recht, die Videos sowie Ausschnitte oder Standbilder daraus in welchem Medium und zu welchem Zweck auch immer (insbesondere auch zu Werbezwecken) zu vervielfältigen, zu senden und der Öffentlichkeit zum Abruf über mobile oder drahtgebundene Dienste (insbesondere im Rahmen der 3Services) zur Verfügung zu stellen. Der Teilnehmer garantiert, dass die eingesandten Videos frei von Rechten Dritter sind und hält H3G in diesem Zusammenhang schad- und klaglos.

Der Rechtsweg ist ausgeschlossen. Keine Barablöse möglich. Das Gewinnspiel unterliegt ausschließlich österreichischem Recht.

Sending of videos is the sole responsibility of participant.

Hutchison 3G Austria GmbH and Lomographic Society reserve the right to remove or decline submissions without notification due to non-compliant content (especially if content is submitted which Hutchison 3G Austria GmbH deems not to be suitable for a public contest) or violation of rules . All participants must agree to the legal guidelines of www.lomography.com.

Winners must claim and use prizes latest by September 2005. Winner must give 4 weeks notice of desired travel date. No alternative prize or other substitution is permitted except by Hutchison 3G Austria GmbH in the event of prize unavailability. Prize is nontransferable/nonsaleable. All federal, state and/or local taxes are the sole responsibility of the winner. All prices have to be collected by Winners in one of Hutchison 3G Austria's shops or sales points.

Prices: All entries will be subject to MMS charges in accordance with the participant's contractual agreement.

Judging:
All entries will be judged by a panel of experts at Lomography, whose decisions are final, based on the following criteria: originality and creativity - 40%; relevance to theme - 40%; artistic impact - 20%. A selection of the best entries will then be judged by a jury (to be announced), who will choose the best entries, based on the following criteria: originality and creativity - 40%; relevance to theme - 40%; artistic impact - 20%. In the event of a tie, tied entries will be rejudged based on the criteria listed above. Winners will be notified by phone or SMS. Winner will have 10 days from notification to accept the prize, and will be instructed whom to contact at that time. If winner is under the age of 16, then entry is disqualified and will be awarded to alternate winner. Neither Hutchison 3G Austria GmbH nor Lomographic Society are responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the winner.

Grand Prize winners may, at Hutchison 3G Austria GmbH's option, be required to sign and return a declaration of eligibility, release of liability, and, where lawful, a publicity consent agreement, all within 10 days of acknowledged notification. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, prize will be forfeited and awarded to an alternate winner. 

By accepting and/or using prizes, winner agrees to the use of their name, voice, town, country, and/or likeness for the purpose of advertising, trade, or promotion without further compensation. In the event of a dispute regarding who submitted a video, the video will be deemed submitted by the authorized holder of the mobile phone by which the video was submitted.

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules (set out herein and in the "General Rules" above).
